The Zadroga Act

What is the Zadroga Act?

H.R. 847 - James Zadroga 9/11 Health and Compensation Act of 2010, called the Zadroga Act, is a bill that passed by the U.S. House of Representatives and U.S. Senate, which will soon become law. When enacted the Zadroga Act establishes the World Trade Center Health Program (WTC Program).

Benefits of the Zadroga Act and its World Trade Center Health Program (WTC Program)

The World Trade Center Health Program (WTC Program) created by the Zadroga Act would provide medical monitoring and treatment of 9/11 related health conditions for emergency personnel, rescue, and clean-up workers who responded to the September 11, 2001 terrorist attacks at the World Trade Center, Pentagon and Shanksville, PA.

The WTC Program would also provide residents of the World Trade Center area, as well as students attending school and people employed in the area, during the 9/11 terrorist attack, rescue and clean-up activities with an initial health evaluation to determine program eligibility, health monitoring and medical care for 9/11 related health conditions.

The Zadroga Act requires the development of an education and outreach program to inform the public of services available under the WTC Program, the collection of health and mental health data on people receiving monitoring or medical care, and the creation of a research program on health conditions resulting from the terrorist attacks.

The Zadroga Act reopens the September 11 Victim Compensation Fund of 2001 (VCF)

The Zadroga Act reopens the Victim Compensation Fund, extending the deadline for first responders, recovery workers and others who suffered injury, financial loss or death of a loved one due to the 9/11 terrorist attacks to recover compensation for the loss.

People may file for compensation from the Victim Compensation Fund even if they received other compensation such as life insurance, health insurance, workers compensation or award/settlements of a civil lawsuit. The amount of compensation already received will be subtracted from any Victim Compensation Fund award.

9/11 responders and workers who settled their cases in the World Trade Center Disaster Site Litigation may be eligible for additional benefits or compensation under the Zadroga Act.
